Terms & Conditions


The following Terms and Conditions (“Terms”) between you the customer (“you” or “your”) and From The Runway (“we,” “our,” “us,” or “FTR”) describes the terms and conditions of which you may access and use the FTR website located at www.fromtherunway.com.au (the “Site”), the FTR mobile App (“App”) and related services including FTR’s product hire and sale services (together with the Site, the App, and the FTR content, as defined below, the “Services”). These Terms and Conditions also apply to in-store hire and sales, which are part of the services. By accessing or using any of the services, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions and FTR's Privacy Policy.

Notice of Agreement

By using the From The Runway site you automatically agree/accept FTR's Terms and Conditions, you automatically agree/accept FTR's Privacy Policy and you agree/accept FTR's Arbitration Agreement where no legal proceeding will be entered into by you against From The Runway for any reason.

Our aim is to give you access to designer clothing and accessories.


    Children under the age of 13 may not use the Services and parents or legal guardians may not agree to these Terms on their behalf. Children under 18 years of age and over 13 years of age may use the site and App under the supervision of parents or legal guardians who agree to be bound by these Terms and Conditions on their behalf, but such children may not hire or purchase any clothing or accessories through FTR services. If you are a parent or legal guardian agreeing to these Terms Conditions for a child between the age of 13 and 18, you accept all liability on their behalf with the hire or purchase of any product including all legal liability they may incur.

    Modification of the Services or our Terms and Conditions

      FTR may modify these Terms and Conditions or modify, suspend, or discontinue the Services at any time for any reason. FTR will use reasonable effort to notify you of material changes to these Terms and Conditions by posting a notice on the Site and/or sending an email to the email address you provided to FTR upon registration.

        Section 2.


        General Conditions

          Services include the hire and sale of products from FTR. FTR’s Terms & Conditions including FTR's Privacy Policy apply to your hire or purchase.

          18 Years or Older.

            Products may be hired or purchased by individuals who are 18 years of age or older using a payment card or other approved payment method. By clicking you agree to FTR’s Terms and Conditions, you acknowledge you are 18 years of age or older and that you are authorized to use your chosen payment method for hiring or purchasing products as described in FTR’s Terms and Conditions.

            Limits. You acknowledge and agree that FTR may place limits on a hire or purchase of products, including but not limited to restricting orders placed under a single customer account, payment card or billing or shipping address. FTR reserves the right to limit, cancel or prohibit any hire or sale of products for any reason, including but not limited to availability and/or geographic concerns.

            Communications. You consent to receive communications from FTR, including email, text messages, calls and push notifications notifying you about the status of your order, sending you reminders, facilitating secondary authentication, and providing other information.


              The following additional conditions apply to the Hire of any product.

              Hire Fee. The hire fee (“Hire Fee”) for any product will be the total of the hire fee of a product, limited insurance and delivery charges listed on our website or App at the time of your checkout when completing a booking. When you complete your booking, you hereby authorise FTR to charge your nominated payment method for the Hire Fee. FTR will charge the amount of the Hire Fee immediately to complete a booking. Once the hire fee transaction is complete, the reservation of your hired product is guaranteed, regardless of how far in advance you complete a booking.

              Cancellation Policy. You may cancel your booking subject to the following cancellation fees and policies:

              If you cancel fourteen (14) or more days in advance of your chosen delivery date, there will be no cancellation fee and you will receive a full refund by reversing the transaction to the payment method you used at the time of your booking.

              If you cancel thirteen (13) or fewer days in advance of your chosen delivery date, you will receive a store credit amounting to no more than the associated booking fee.

              Return Packaging. With every delivery, FTR provides you with a 3kg Australia Post pre-paid satchel with instructions advising how to return the hired product to FTR.

              Receipt of the Product(s). At delivery, you accept responsibility for your hired product(s). You agree to accept responsibility for receipt of your hired product(s) shipped to the location specified at the time of your check out. You acknowledge that the shipping address is a safe and secure location where an individual can physically receive product(s). If an un-secured shipping address is provided, FTR does not accept liability for any product(s) left unattended. Furthermore, you acknowledge that providing anything other than a Secure Shipping Address may result in delivery delays and additional delivery fees for which FTR will not be liable. You accept liability for all such delays and any additional delivery fees.

              Use of the Products. You agree to treat the product(s) with great care. You accept all liability for any damage, theft, mysterious disappearance, fire, major stains or any other cause that renders the product(s) unusable. Normal wear and tear like missing beads, stuck zippers or slight damage will be covered by the insurance you paid for as part of your booking. If you return a product that is damaged beyond normal wear and tear, you agree that FTR is within its rights to pursue all financial loss.

              Return of the Products; Extensions. You agree to return the product(s) to FTR in the return packaging on or before the return due date for the product(s) hired. FTR will supply you with the expected return date at the time you complete a booking either in store or online. You may extend any product hire by phoning FTR on +61 2 82831633 or email us at info@fromtherunway.com.au subject to any bookings for that product during the requested extension period.

              Late Fees. If you return a hired product(s) after your booked hire period or not at all, you will be charged a late fee of fifty dollars ($50.00) per day until the product is in the possession of FTR staff. You authorise FTR to process your late fee using the same payment method you used to pay for your booking. FTR agrees to process late fees up to an amount not to exceed 100% of the recommended retail price (RRP) of your hired product(s) at the time of your booking, this fee is on top of your hire fee, plus any financial loss suffered by FTR due to pre-bookings during the period which the product was late or not returned. A late fee is payable for each product(s) booked that is not returned by its return due date. If you have not returned a product(s) within five (5) days after the return due date, your hire will be considered a non-return.

              Lost Return Packaging. If you misplace the return satchel, you are responsible for returning the hired product to FTR at your own expense by the expected return due date and you are required to provide FTR staff with a tracking number.

              Correct Products. Subject to availability, FTR will deliver the product(s) you ordered on or before the requested delivery date, except in the rare event that the product was damaged beyond repair during a previous booking. In such an event, FTR will use reasonable efforts to notify you that the product is unavailable.

              Cleaning. The products(s) will be professionally cleaned by FTR ONLY. FTR use professional cleaners to dry clean each product using the manufacturers cleaning instructions. Any attempt to clean our garment/s by you that results in damage caused to the garment will result in paying the RRP of that garment illustrated at the time of your booking.


                  The following additional conditions apply to any sale of any Product.

                  Products are New and Used; You acknowledge and agree all Sales are Final and “As Is” and that only products designated for sale by FTR are available for purchase. FTR professionally clean and inspect product(s) before they are delivered to you. However, all Products are sold on an “as is” basis, without any warranty whatsoever, and all product sales are final.

                  Content Provided is “As Is.” All content and information available through our services, including but not limited to product descriptions, product specifications, product photos and comments from other users is available to you on an “as is” basis and is to be used for general information purposes only. Such information is provided on a blind-basis, without any knowledge as to your identity or specific circumstances. The FTR Content is provided with the understanding that such information does not constitute professional advice or services. As such, you agree not to rely upon or use any FTR Content as a substitute for consultation with professional advisors.

                  FTR Content Updates. FTR may update the FTR Content as we deem appropriate and without notice to you.

                  Acceptable Use Policy

                    Use of FTR Content. FTR Services, including the FTR Content, may not be reproduced or transmitted in any form or by any means, except when FTR authorizes you to view, copy, download or print. Subject to your compliance with these terms and conditions, FTR grants to you a limited, non-exclusive, non-transferable, revocable license to access and use our services for your personal and non-commercial purposes.


                      By sending FTR feedback, ideas, suggestions, documents or proposals, you grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, prepare derivative works of, publish, distribute, sublicense and otherwise exploit the Feedback, and you waive all moral rights in the feedback which may be available to you in any part of the world and confirm that no such rights have been asserted. You represent and warrant that the feedback does not contain any confidential or proprietary information of any third party, and that FTR may use your feedback without restriction or obligation to you or any third party.

                      Termination by You

                        You may terminate your FTR membership at any time by contacting us info@fromtherunway.com.au. You acknowledge that your feedback may continue to exist and be used by FTR even after termination of membership.



                        Section 4.

                        DISPUTE RESOLUTION

                        Informal Process First

                          Both FTR and you agree that in the event of any dispute, FTR and you will first contact each other and make a good faith sustained effort to resolve the dispute before resorting to more formal means of resolution.

                          Mandatory Arbitration of Disputes

                            All disputes will be resolved by binding arbitration. Your rights will be determined by a neutral arbitrator, not a judge or jury. You agree that any dispute arising out of or relating to these terms and conditions, including with respect to the interpretation of any provision of this agreement or concerning the performance or obligations of FTR or you, shall be resolved by mandatory arbitration at the request of either FTR or you pursuant to the following conditions:

                            Place of Arbitration Hearings. Unless you elect to conduct the arbitration by telephone or written submission, an in-person arbitration hearing will be conducted at a neutral venue.

                            Force Majeure. FTR will not be made liable for or be in breach of these terms and conditions due to a delay or failure to perform set in these terms and conditions as a result of any cause or condition beyond FTR’s reasonable control.
